Clerico, District Judge. The defendant, Garry T. Wade, appeals his conviction and sentence for bank robbery in violation of 18 U.S.C.A. Â§ 2113(a). He asserts that the evidence introduced at trial was not sufficient to support a conviction under the statute. He further asserts that the district courts refusal to depart downward was based on an erroneous belief that the court lacked the authority under the guidelines to do so. We affirm the conviction. We lack jurisdiction to review the sentence.
